On August 21, 2024, a federal judge in Texas has blocked the U.S. Federal Trade Commission’s (FTC) rule that would have banned employers from requiring non-compete agreements for their employees. Originally set to take effect nationwide on September 4th, this rule is now on hold.
Judge Ada Brown of the U.S. District Court in Dallas ruled that the FTC overstepped its authority by trying to implement such a sweeping ban. She stated that the rule was “arbitrary and capricious,” and as a result, it has been set aside and will not be enforced.
Judge Brown emphasized that the FTC failed to provide sufficient evidence to justify banning virtually all non-compete agreements, instead of targeting specific, harmful practices.
Although this ruling is a setback for the FTC, it does not prevent the agency from pursuing non-competes on a case-by-case basis. The legal battle over this issue is far from over, and an appeal could extend the litigation for years, potentially reaching the Supreme Court.
As the situation unfolds, it will be interesting to see how this impacts employers and workers across the country.
What’s Next for Employers?
For now, there’s nothing more for employers to do but wait and see if the FTC will appeal the recent ruling. If an appeal does happen, it will likely be some time before a final decision is made.
In the meantime, it’s a good opportunity for employers to revisit their non-compete agreements and update them.
